London Borough of Waltham Forest's Early Years Strategy states that ‘we will measure our success in the following ways’:

  1. All Early Years and Childcare provision are high quality, inclusive and safe and prepare children for school;
  2. The Early Years workforce has access to support, advice and training as well as development opportunities that lead to strong leadership & governance and quality service delivery.

What requirements do childcare providers have to meet?

In addition to the requirements outlined by Ofsted, there are a number of legal and statutory requirements for which Ofsted are not the regulatory body, or do not have overarching responsibility, however childcare providers MUST comply with these requirements by law. The key areas with regards to keeping children, staff and service users safe are Health and Safety, Employment Law, Safeguarding and Finance.

The Local Authority (LA) has overarching responsibility for safeguarding and promoting the welfare of all children and young people in their area. We have a number of statutory functions under the 1989 and 2004 Children Acts which make this clear. This responsibility is outlined in the Government's document 'Working together to safeguard children'.

The LA do not commission providers to deliver Free Early Education Entitlement (FEEE) places to eligible children, unless they can demonstrate that they have an understanding of and comply with key elements of Health and Safety, Employment, Safeguarding and Financial statutory/legal requirements.

The Early Education and Childcare statutory guidance for Local Authorities  states that the LA can place requirements on providers which relate to keeping children safe and can refuse to fund providers who are unable to meet these requirements.

What is the aim of these compliance checks?

These compliance checks aim to:

  1. Work in partnership with childcare providers to establish whether their assessments of their compliance with the requirements within it are in line with the LA's.
  2. Empower childcare providers to understand and comply with their key/statutory requirements in order to inform their service/development/action plans and improve the quality and safety of their provision.
  3. Enable childcare providers to take appropriate action to reduce the risk of them failing to keep children safe.
  4. Identify where there are non-compliance issues and provide recommendations/information to enable childcare providers to meet their legal/statutory requirements.
  5. Allow the LA to establish where there are common areas of development or where support, advice and training is required which will inform Early Years strategic planning.
  6. Make the requirements the LA places on providers clear in relation to keeping children safe to avoid the need to refuse to fund providers who are unable to meet these requirements.
  7. Give an overview/snapshot of compliance with key statutory requirements at the time of the health check being undertaken

What requirements do providers need to meet to be commissioned to deliver the Free Early Education Entitlement (FEEE) in Waltham Forest?

Prior to the LA issuing a contract to a DfE-registered school or Ofsted-registered childcare provider to deliver FEEE places to eligible 2, 3 &4 year olds, the LA requires providers to demonstrate their understanding and compliance with key statutory/legal requirements; Health and Safety, Employment Law, Safeguarding and Finance requirements by undertaking the relevant compliance checks in line with the steps below.

The Compliance Checks are:

1. LBWF FEEE Business Compliance Check 1 for All Schools & PVIs

2. LBWF FEEE Premises, Health & Safety Compliance Check 2 for All Schools & PVIs

3. LBWF FEEE Compliance Check for Childminders ONLY

Please Note: It is important for providers (Schools & PVIs) to be aware that should your compliance check submissions require any more than 2 evaluations by the Early Years Childcare and Business Development Service (step 5 and step 8) and more than a single site visit (step 10) to successfully complete the compliance check process, all subsequent Compliance Check evaluations and site visits will be chargeable at £425 per day.

It is therefore vital that childcare providers submit quality Compliance submissions to avoid cost implications associated with reviews of multiple submissions.

How do I complete Compliance Check 1 and 2?

Step 1

All new providers that are required to complete Compliance Check 1 &2 must complete the compliance checks independently via “Virtual College (VC)”.  Providers must first register via Virtual College  . Once registered, send an email to FEEEprovision@walthamforest.gov.uk and provider will be allocated Compliance Check 1 and 2 to complete. 

Step 2

Complete the online compliance check via “Virtual College (VC)”. To ensure the quality and completeness of your submission and increase the likelihood of completing the process in a timely manner, please ensure that you refer to the help text throughout the compliance check document. Use the detailed guidance on The Hub and other guidance provided on HSE Website to inform the information/documentation that you submit on VC and upload copies of all required information/documentation.

Step 3

Attend any relevant Waltham Forest Training that will assist you with completing the compliance check. Providers may consider seeking any external additional specialist/professional advice that you may need to complete the compliance check.

Step 4

Once your VC submission is 100% complete, you must send an e-mail to FEEEprovision@walthamforest.gov.uk so that the Early Years, Childcare and Business Development Service can begin their evaluation of each Compliance Check. A confirmation of email receipt will be sent to provider.

Step 5

The Early Years, Childcare and Business Development Service will aim to review your completed submission within 8 weeks of your e-mail confirmation of submission (Step 4). If your compliance check submission has missing and/or inaccurate/unclear documentation this will delay the process further.

Once your submission has been reviewed by the EYCBDS, You will either:

  • Receive email confirmation that your compliance check submission has met the required standards which would allow us to arrange a site visit to your premises for a final check. Or
  • Be provided with evaluation feedback via email that will outline the result of the evaluation and any action that needs to be taken by you to ensure that the submission meets the required standards.

Step 6 - for providers whose compliance checks 1 and/or 2 VC submission were not successful at step 5 only.

You will be expected to action and make the required amendments/additions as outlined in the evaluation feedback provided by the Early Years, Childcare and Business Development Service.

Step 7 - for providers whose submission was not successful at step 6 only.

Once the evaluation feedback has been actioned send an e-mail to FEEEprovision@walthamforest.gov.uk so that it can be reviewed again by the Early Years Childcare and Business Development service. A confirmation of receipt email will be sent to provider.

Step 8

Please be aware that any re submission of compliance check 1 or 2 may result in the 8 week timeline to be re commenced.

The Early Years Childcare and Business Development Service will aim to review your second submission within 8 weeks of your e-mail to confirm that your submission is complete (step 7). If your submission has missing and/or inaccurate/unclear documentation this will delay the process further.

Once review has been completed, you will either:

  • Receive email confirmation that your submission has met the required standards and arrange a site visit (see step 10) or
  • Be provided with feedback via  email that will outline the result of the second review and any further action that needs to be taken to ensure that the submission meets the required standards in order to be issued a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

Step 9 - for providers whose submission was not successful at step 8 only

Providers will be provided with an invoice for the number of days required to complete the subsequent review, which MUST be paid before the review can commence.

Provider will repeat step 7 and 8 until

  • Provider receives confirmation that submission has met the required standards and arrange a site visit for (see step 10) or
  • Provider is provided with feedback via email that will outline the result of the review and action that needs to be taken to ensure that the submission meets the required standards in order to be issued a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

Step 10

Site visits will be arranged for each compliance checks. The LA officer at the site visit will speak to key staff to ensure that they demonstrate a good understanding of, and comply with, key elements of both compliance checks and review any further supporting/additional documentation resulting from speaking with the key staff.

All Ofsted registered responsible persons MUST be available for site visits, failure to comply with this will result in the visit been cancelled. Providers must provide at least 24hours notice of site visit cancellation via email to FEEEprovision@walthamforest.gov.uk should this be the case. If adequate notice has not been received from the provider, this will be chargeable to the provider at £200 half day visit.

Step 11

Following the site visit, you will:

  • Receive email confirmation that your compliance check and site visit have met the required standards and you will be offered a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Be provided with feedback via email  that will outline the result of the site visit and action that needs to be taken to ensure that the submission meets the required standards in order to be issued a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds (see step 12) or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

Step 12- only for providers who did not successfully complete step 11

Provider will need to repeat step 10 and 11 until:

  • Receive email confirmation that your submission has met the required standards and arrange a site visit or
  • Submission is approved and you receive confirmation that your submission that has met the required standards and will be offered a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

How do I complete Compliance Check – For Childminders ONLY

Step 1

Attend any relevant WF Trainings & Events that will assist you with completing the compliance check. Seek any advice from your Childminding Development Officer that you may need to complete the compliance check.

Step 4

Once your VC submission is 100% complete, you must send an e-mail to FEEEprovision@walthamforest.gov.uk so that the Early Years, Childcare and Business Development Service can begin their evaluation of each Compliance Check. A confirmation of email receipt will be sent to provider.

Step 5

The Early Years, Childcare and Business Development Service will aim to review your completed submission within 4 weeks of your e-mail confirmation of submission (Step 4). If your compliance check submission has missing and/or inaccurate/unclear documentation this will delay the process further.

Once your submission has been reviewed by the EYCBDS, You will either:

  • Receive email confirmation that your compliance check submission has met the required standards which would allow us to arrange a site visit to your premises for a final check. Or
  • Be provided with evaluation feedback via email that will outline the result of the evaluation and any action that needs to be taken by you to ensure that the submission meets the required standards.

Step 6 - for providers whose compliance check VC submission was not successful at step 5 only.

Step 7 - for providers whose submission was not successful at step 6 only.

Step 8

  • Receive email confirmation that your submission has met the required standards and arrange a site visit (see step 10) or
  • Be provided with feedback via  email that will outline the result of the second review and any further action that needs to be taken to ensure that the submission meets the required standards in order to be issued a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

Step 9

A site visit will be arranged by a Development Officer to speak to provider to ensure that they demonstrate a good understanding of, and comply with, key elements of the FEEE compliance check and review any further supporting/additional documentation resulting from speaking with the provider.

Ofsted registered responsible person MUST be available for site visit, failure to comply with this will result in the visit been cancelled. Provider must provide at least 24hours notice of site visit cancellation via email to FEEEprovision@walthamforest.gov.uk should this be the case.

  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

Step 11- only for providers who did not successfully complete step 11

Provider will need to repeat step 9 and 10 until:

  • Receive email confirmation that your submission has met the required standards and arrange a site visit or
  • Submission is approved and you receive confirmation that your submission that has met the required standards and will be offered a contract to provide Free Early Education Entitlement (FEEE) places to eligible 2,3 &4 year olds or
  • Provider may withdraw from the FEEE compliance check process by notifying the EYCBD service via email to FEEEprovision@walthamforest.gov.uk

How long does the process take?

We aim to work with providers to complete the compliance check process within 8 weeks (4weeks for Childminders) of confirmation by the LA of submission of fully completed compliance check along with the relevant supporting documents/evidence. However, satisfactory completion of the process is dependent on providers having the policies, procedures and trained staff in place and submitting the correct information within this timeframe. What happens once I have been approved for all relevant Compliance Checks?

You will need to have been approved for all relevant compliance checks before you can be commissioned by the LA to deliver the FEEE; no contract will be issued until they have been approved as meeting the required standards.

The commencement date for your FEEE contract would be the date that you receive confirmation of approval of Compliance Checks 1 and 2 (whichever is the later).                     

The commencement date for your Childminder’s FEEE contract would be the date that you receive confirmation of approval of Compliance Check.

Please note: FEEE payments will only commence from the contract start date; no retrospective payments will be made.

Providers will be reassessed annually for compliance check via Virtual College to ensure ongoing compliance.
